Terms of Service

The agreement between you and us for using Citewise AI. Written to be read, not just accepted.

1. Agreement

These Terms of Service ("Terms") govern your use of Citewise AI, including the website at getcitewiseai.com, the web application, free tools and API (together, the "Service"). The Service is provided by INCAA LLC, a Missouri limited liability company with its mailing address at 8301 State Line Rd, Ste 220-2254, Kansas City, MO 64114, United States ("INCAA LLC", "we", "us"). Citewise AI is a brand of INCAA LLC.

By creating an account, purchasing credits or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm you are authorized to accept these Terms for it. You must be at least 18 years old to use the Service.

2. The Service

Citewise AI is web-based software that sends prompts you define to third-party AI systems (currently ChatGPT, Gemini, Perplexity, Claude) through their official APIs, records the answers, and analyses them for mentions of brands, competitors and cited sources. Results are presented in a dashboard, reports, exports and via API. The Service is delivered online; nothing is shipped.

We also offer free tools that check publicly available information about websites (such as robots.txt files and page metadata).

3. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. One person or organization may not create multiple accounts to obtain additional free credits. Notify us promptly at [email protected] if you suspect unauthorized access.

4. Credits, pricing and payment

  • Credits. The Service is paid for with credits. One credit is consumed for each check: one prompt answered by one AI engine. The number of credits a run will use is shown before you start it.
  • Free credits. Every account receives 25 free credits at the start of each calendar month. Free credits expire at the end of the month in which they are granted and have no cash value.
  • Credit packs. You may buy one-time credit packs: Starter Pack ($29 for 600 credits), Growth Pack ($79 for 2,000 credits), Agency Pack ($199 for 6,000 credits). Prices are shown in US dollars. Credit packs are one-time purchases. They are not subscriptions and never renew automatically.
  • Validity. Purchased credits are valid for 12 months from the date of purchase. Credits that expire soonest are used first.
  • Failed checks. If a check fails because an AI engine errors or times out, its credit is returned to your balance automatically.
  • Nature of credits. Credits are a prepaid right to use the Service. They have no cash value, cannot be withdrawn, transferred, sold or exchanged, and can only be used within the Service.
  • Payment processing. Payments are processed by Polar Software, Inc. ("Polar"), which acts as Merchant of Record for purchases. Polar handles checkout, calculates and collects applicable sales tax or VAT, and issues receipts. We do not receive or store your full card details. Polar's terms apply to the payment transaction.
  • Price changes. We may change pack prices for future purchases. Changes never affect credits you have already bought.

5. Refunds

You may request a full refund of a credit pack within 14 days of purchase if less than half of that pack's credits have been used. Full details are in our Refund Policy, which forms part of these Terms.

6. Acceptable use

You agree not to:

  • use the Service to generate, request or store unlawful, harmful, harassing, defamatory or infringing content, or prompts designed to make AI systems produce such content;
  • use the Service in a way that violates the usage policies of the AI providers it connects to;
  • attempt to probe, scan or breach the Service, bypass rate limits or credit accounting, or access other customers' data;
  • use the free tools to target systems you are not authorized to test, or to send automated high-volume requests;
  • resell or provide raw access to the Service as a standalone product. Agencies may use the Service to serve their own clients and share reports with them;
  • misrepresent Citewise AI results as endorsements by any AI provider.

We may suspend accounts that violate this section. Where practical, we will contact you first.

7. Third-party AI providers

Answers are produced by third-party AI systems that we do not control. Their outputs can be inaccurate, incomplete or change without notice, and an engine may be temporarily unavailable or replaced. API answers may differ from answers shown in the providers' consumer apps. We do not endorse the content of any answer. Engine availability depends on the providers; if an engine is unavailable, runs proceed with the remaining engines and you are only charged for checks that complete.

8. No guarantee of outcomes

Citewise AI measures and reports how AI systems respond to prompts. We do not and cannot guarantee that any AI system will mention, recommend or cite your brand, or that any action you take will change its answers. Recommendations and guidance in our content and tools are informational.

9. Your content and data

You keep all rights to the information you put into the Service, such as brand names, competitors and prompts ("Customer Content"), and to the results generated for you. You grant us a limited license to process Customer Content solely to provide the Service, including sending prompts to the AI providers you select. Do not include personal data or confidential information in prompts. Our handling of personal data is described in the Privacy Policy. You can export your results to CSV and delete your projects or account at any time.

10. Our intellectual property

The Service, including its software, design, text and the Citewise AI name and logo, is owned by INCAA LLC and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your use of it. You may share reports generated for you. If you send us feedback, we may use it without obligation.

11. Availability and changes

We work to keep the Service available and reliable, but it is provided without a guaranteed uptime commitment. We may modify, add or remove features. If we discontinue the Service entirely, we will give at least 30 days' notice and refund unused purchased credits that have not expired, pro rata.

12. Termination

You may stop using the Service and delete your account at any time from Settings. Deleting your account permanently removes your projects and results; unused credits are forfeited unless a refund is due under the Refund Policy. We may suspend or terminate access for material breach of these Terms. If we terminate for reasons other than your breach, we will refund unused, unexpired purchased credits pro rata.

13. Disclaimers

Except as expressly stated in these Terms, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the maximum extent permitted by law.

14. Limitation of liability

To the maximum extent permitted by law, INCAA LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or US $50 if greater. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to indemnify INCAA LLC against third-party claims arising from your Customer Content or your violation of these Terms, to the extent permitted by law.

16. Governing law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict-of-law rules. The state and federal courts located in Jackson County, Missouri have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer, you keep any mandatory protections of the law of your country of residence.

17. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in the app at least 14 days before they take effect. The "Last updated" date shows the current version.
